PART 1

About HotelsMint & These Terms

1.1 Who We Are

Bankitt LTD (company number 12780965, registered in England and Wales), trading as "HotelsMint.com", operates the online platform at www.hotelsmint.com. Registered office: 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF. HotelsMint is a multi-service platform offering: (a) hotel and accommodation booking services; (b) a guest loyalty and rewards programme; (c) a B2B supplier marketplace for hotel operators. Financial services (digital wallet, virtual cards, fund transfers) are governed separately under the Financial Services Terms.

1.2 Acceptance

By accessing or using any part of the HotelsMint platform — whether as a guest, a hotel partner guest, a marketplace buyer, or any other user — you confirm you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must discontinue use immediately. These Terms are supplemented by the Privacy & Cookie Policy, Financial Services Terms (where applicable), and Legal & Ethics Charter, all available at www.hotelsmint.com. In the event of conflict, the more specific document prevails.

1.3 Changes to These Terms

We may update these Terms at any time. For material changes, we will give prominent website notice. Continued use after the effective date of any change constitutes acceptance. If you do not accept, you must stop using the platform before the effective date.

Eligibility & Accounts

2.1 Eligibility Requirements

To access, register, or use the platform, you must meet the following baseline eligibility criteria:

  • Be aged 18 or above for all financial services, digital wallets, and marketplace features.
  • Be aged 16 or above for hotel and accommodation booking services (with explicit parental or guardian consent required for any users under the age of 18).
  • Possess full legal capacity to enter binding contracts under the laws of your local jurisdiction.
  • Not be subject to financial or trade sanctions, export controls, or otherwise prohibited from accessing the platform or services.
  • Provide truthful, accurate, and complete information at all times.
  • Not have been previously suspended, banned, or terminated from using the HotelsMint platform.

2.2 Account Registration Guidelines

By registering for an account, you agree to: provide accurate, complete, and current info; keep your details updated; and maintain the strict confidentiality of your login credentials. You are permitted to register only one account. The creation of duplicate or proxy accounts to bypass restrictions, suspensions, or booking limits is strictly prohibited.

2.3 Account Security & Monitoring

You are solely responsible for all actions and transactions that occur under your registered account. You must notify info@hotelsmint.com immediately of any suspected unauthorized access or compromise. HotelsMint reserves the right to suspend or terminate accounts that breach these Terms immediately, without prior notice where necessary to prevent harm, fraud, or broader network security threats.

PART 3

Hotel Booking Service

3.1 Nature of Service — Platform Intermediary

Legal Disclaimer & Intermediary Position

HotelsMint operates as a technology intermediary, not as a hotel, accommodation provider, or travel agency. When you purchase or secure a booking, you enter into a direct, legally binding contract for lodging with the respective hotel partner. HotelsMint (Bankitt LTD) is not a partner or party to that accommodation contract and accepts no liability in any country for the hotel's performance, quality, amenities, safety, compliance with local equality and discrimination acts, building regulations, licensing, or any other acts or omissions of the property. This structural separation mirrors standard Online Travel Agency (OTA) intermediary models.

3.2 The Booking Process Flow

The booking process is structured as follows:

  1. 1Select the preferred hotel, check-in/out dates, room type, and number of guests.
  2. 2Review the total checkout price, inclusive of all mandatory taxes and charges (as detailed in Section 3.4).
  3. 3Review the specific hotel's cancellation guidelines and internal house policies.
  4. 4Input accurate guest information and provide valid payment credentials.
  5. 5Confirm the booking — this action constitutes your binding contractual offer to the accommodation provider.
  6. 6Receipt of an email confirmation from HotelsMint — which represents the hotel's formal acceptance and completes/confirms the booking.

If you do not receive an email confirmation within 24 hours of booking, please contact info@hotelsmint.com immediately with your payment transaction reference. You are responsible for ensuring all booking attributes are correct at checkout.

3.3 Hotel Partner Liability — Global Scope

Legal Disclaimer & Intermediary Position

Hotel partners operate as independent businesses, not as employees, franchises, or agents of HotelsMint. HotelsMint does not own, run, manage, view, or control partner properties. Hotel partners are fully and solely liable in every jurisdiction for: accommodation quality, safety, and fitness; health, fire, and construction compliance; food hygiene; non-discriminatory treatment of guests under applicable local and international laws; employment law compliance; local business licences; guest data security at the property; personal injury, death, or property damage; tax obligations; and all other regulatory duties. HotelsMint excludes all liability for any partner's failure to meet these obligations. Complaints must be logged with the hotel operator directly.

3.4 Pricing Transparency — DMCC Act 2024

In strict compliance with the UK's Digital Markets, Competition and Consumers (DMCC) Act 2024:

  • The price shown at checkout represents the absolute total price, inclusive of all mandatory taxes (such as VAT or local sales tax) and platform fees. Optional extras (such as breakfasts, parking, or spa access) are broken out and only charged if actively selected.
  • Local city or tourism taxes may be collected at the property in accordance with regional regulations.
  • HotelsMint guarantees no drip pricing, hidden charges, or misleading price displays. Valid currency conversion rates are established at the point of payment.

3.5 Cancellation & Refund Policy

Booking refundability is defined by the rate type selected prior to final checkout confirmation:

  • Free Cancellation: Cancelling before the stated deadline (typically 24 to 72 hours prior to check-in) is free. Cancellations after this time are charged in accordance with the hotel policy.
  • Non-Refundable: Full booking value is charged immediately. No refunds, credits, or dates changes are permitted.
  • Partially Refundable: Specific criteria apply (e.g. the first night value is retained as a non-refundable deposit, with the remaining balance returned).

Statutory Cooling-Off Exclusion: Statutory 14-day cooling-off rights under the Consumer Contracts Regulations 2013 do not apply to bookings for accommodation on specific dates (Regulation 28(1)(h), mirrored in Article 16(l) of the EU Consumer Rights Directive). This is a legal exclusion, not a HotelsMint policy. Booking confirmation constitutes acknowledgment of this exclusion. To cancel a booking, go to 'My Bookings', select the booking and cancel, or contact info@hotelsmint.com. Refund processing to the original payment method takes up to 14 business days from supplier settlement. In cases of overbooking, the hotel must provide equivalent/superior alternatives or a full refund; HotelsMint assists but is not liable.

3.6 Modifications, No-Shows & Force Majeure

Booking modifications are subject to room availability, hotel policies, and rate restrictions. No-shows are charged in accordance with hotel policy (up to 100% of the total booking value). In force majeure events (e.g. natural disasters, pandemic lockdowns, or border controls), HotelsMint will negotiate with partners to seek the best possible outcome. Default statutory rights are unaffected, and final decisions rest with the hotel or inventory supplier.

3.7 Package Travel Regulations 2018

Where a booking qualifies as a 'package' or a 'linked travel arrangement' under the UK Package Travel and Linked Travel Arrangements Regulations 2018 or EU Package Travel Directive (2015/2302), HotelsMint will clearly notify you at purchase, and the additional legal protections under those acts will apply.

PART 4

Rewards Programme

4.1 Overview

The HotelsMint Rewards Programme (upon formal launch) allows users to accumulate 'Mint Points' for qualifying transactions on the platform and redeem them. Participation is optional and bound by these terms.

4.2 Accumulating Points

Points are earned on completed activities as follows:

  • Completed bookings: points per £1/€1 value spent, as shown at checkout.
  • Wallet actions: bonus points on promotional wallet transactions or selected partner card use.
  • B2B Marketplace: points per currency unit spent on marketplace supply trades.
  • Referrals: points on verified friend invites who complete their first booking.
  • Promotions: campaigns subject to specific advertised rules.

Points credit within 72 hours of activity. Points earned on bookings that are subsequently cancelled will be reversed.

4.3 Nature & Value of Points

Mint Points do not possess any cash value and cannot be exchanged for currency. Points are personal, non-transferable, and non-saleable. They are not financial instruments, investments, or regulated monetary assets. Redemption rates and offers are subject to change, with 30 days' notice for material decreases. All points expire on account closure.

4.4 Redeeming Points

Redemptions are supported for:

  • Hotel bookings: Applied at checkout (minimum threshold of 500 Points).
  • Wallet Credit: Converted to wallet balance (minimum threshold of 1,000 Points).
  • Merchant Rewards: Upgrades or partner vouchers subject to availability.
  • Marketplace: B2B transaction offsets.

All point redemptions are final. Points applied to bookings that are cancelled cannot be restored.

4.5 Tier Status

Membership tiers (Standard, Silver, Gold, Platinum) are calculated based on points generated over a rolling 12-month period. Higher tiers afford higher earning multipliers, exclusive deals, and prioritized customer support.

4.6 Points Expiry

Points expire after 12 consecutive months of account inactivity (no qualifying earning or redemption transactions). Any active qualifying transaction resets the 12-month expiry duration.

4.7 Programme Modification & Termination

HotelsMint may modify or cancel the Rewards Programme at any time. We will provide 30 days' advance notice for material changes. If the programme is terminated, users have 60 days to redeem points. Any fraudulent earning or referral manipulation results in forfeiture of points and account suspension.

PART 5

Supplier Marketplace

5.1 Nature of the Marketplace

Legal Disclaimer & Intermediary Position

The Supplier Marketplace is a B2B platform enabling hotel operators to purchase items directly from hospitality suppliers. HotelsMint acts as a technology intermediary only. We are not a party to supply contracts. Suppliers are solely responsible for: product safety, quality, and legal compliance; shipping, delivery, and warranties; labour and employment law compliance; non-discrimination; environmental compliance; and all legal conditions. HotelsMint's liability is capped at the marketplace fee received. Full conditions are set in the Supplier Agreement.

5.2 Buyer Conduct

Buyers must transact in good faith, pay costs promptly, and comply with all applicable laws. Marketplace buyers must not discriminate against suppliers on protected grounds.

5.3 Prohibited Marketplace Listings

The following items and listings are strictly prohibited on the B2B marketplace:

  • Counterfeit, brand replicas, or goods violating third-party intellectual property rights.
  • Products that fail to meet UK, EU, or international product safety regulations.
  • Controlled substances, weapons, explosives, or illegal items.
  • Services requiring professional licences that the supplier does not hold.
  • Any products or services whose trade is a criminal offence in the region of transaction.
PART 6

IntelProperty & Usage Rights

6.1 Platform Ownership & License Details

All platform content — including text, brand graphics, trademarks, logos, design templates, layouts, systems, databases, codes, and interface architectures — is owned by or licensed to HotelsMint (Bankitt LTD) and protected by UK and international intellectual property laws. Users receive a limited, non-exclusive, non-transferable, revocable licence to access the platform for booking purposes. You may not copy, extract, distribute, reverse-engineer, decompile, crawl, or exploit our assets without express written consent.

6.2 User-Submitted Content & Reviews Licence

By posting reviews, photos, listings, or details on the platform, you grant HotelsMint a worldwide, royalty-free, perpetual, sub-licensable, and transferrable license to use, reproduce, modify, translate, and showcase that media for operational and marketing functions. You warrant you own the rights to post this and that it does not infringe third-party rights.

PART 7

Acceptable Use Policy

7.1 General Prohibited Conduct

When using the platform, you must not engage in any of the following prohibited behaviors:

  • Using the platform for any illegal purpose under English law or the laws of your location.
  • Facilitating money laundering, tourist and financial fraud, or any monetary crime.
  • Filing false, misleading, or deceptive bookings, account details, reviews, or B2B listings.
  • Impersonating another person, business representative, or staff member.
  • Disrupting, hacking, overloading, or attempting to breach the servers, systems, or data security.
  • Crawling, scraping, or indexing our pages using automated scripts or scrapers without auth.
  • Attempting unauthorized login, bypass controls, or decrypt user credentials.
  • Reverse-engineering, decompiling, or stealing backend source files.
  • Circumventing rate limiters, firewall rules, or fraud prevention layers.

7.2 Fake Reviews & Deceptive Practices — DMCC Act 2024

Submitting, soliciting, or rewarding fake reviews is a criminal offence under the DMCC Act 2024 for business users. HotelsMint maintains a zero-tolerance review policy, verified through automated and manual methods. Violations result in account deletion, content removal, and reporting to the Competition and Markets Authority (CMA). Drip pricing, misleading list pricing, false urgency counters, and misleading Auto-Renewals are also prohibited.

7.3 Discrimination & Hate Speech — Zero Tolerance

Critical Policy Warning: Zero-Tolerance Policy

HotelsMint prohibits absolutely, in all languages, contexts, and sections of the platform: racism, xenophobia, antisemitism, Islamophobia, homophobia, transphobia, or any hatred, prejudice, or harassment based on race, colour, nationality, ethnic or national origin, religion or belief, gender, sexual orientation, disability, age, political opinion, language, caste, or any other personal characteristic. This applies to all reviews, direct messages, marketplace listings, and user-generated content. Violating content is removed immediately and user accounts are permanently banned. Criminal hate offences (under the Public Order Act 1986, Crime and Disorder Act 1998, or Online Safety Act 2023) will be reported directly to law enforcement.

7.4 Exploitation & Forced Labour

Using the platform to organize or enable human trafficking, modern slavery, exploitation, or forced labour is strictly banned. Any suspicious activities will be immediately reported to the National Crime Agency (NCA) and police services.

PART 8

User Reviews & Guidelines

8.1 Submission Policy

By submitting reviews, ratings, or media, you warrant that: your reviews reflect your genuine experience; content is original; you own the rights; and it does not contain private details of others. HotelsMint reviews represent user views; we do not modify or edit review copy to preserve integrity, though we reserve the right to remove non-compliant files.

Third-Party Integrations

9.1 External Services & Links

The platform contains links to external sites, payment gateways, mapping networks, and marketing tools. HotelsMint is not responsible for the availability, legal policies, safety, or accuracy of third-party systems. Use of outside nodes is at your own risk and subject to their respective policies.

PART 10

Limitation of Liability

10.1 Liability Limits

To the maximum extent permitted by law, HotelsMint's total aggregate liability for all claims under the platform is capped at:

  • Hotel bookings: The total transaction fee value paid for the booking in dispute.
  • Marketplace: The total platform fee collected from that transaction.
  • Rewards: The cash-equivalent value of the Mint Points in dispute.

10.2 Exclusions

We exclude all liability for: partner hotel conduct, hygiene, safety, or defaults; description or image accuracy; lost revenues, profits, savings, data, or reputation; remote or indirect losses; and downtime caused by maintenance, supplier issues, or force majeure events.

10.3 Non-Excludable Rights

Nothing in these terms limits or voids our liability for death or injury caused by negligence, fraud, or intentional defaults, or any liability that cannot be barred under English consumer law. Statutory consumer controls are preserved.

10.4 Financial Wallets

Wallet, payment card, and funds transfer processing are governed separately under the Financial Services Terms and the Payment Services Regulations 2017.

PART 11

Indemnification

11.1 User Indemnity Duties

You agree to indemnify, defend, and hold harmless HotelsMint (Bankitt LTD), its directors, officers, employees, and affiliates from all claims, damages, liabilities, losses, and legal costs arising from: your breach of these Terms, your violations of law, any inaccurate content you submit, or infringement of third-party IP or rights.

PART 12

Dispute Resolution & Laws

12.1 Governing Law

These Terms and any non-contractual claims are governed by the laws of England and Wales. Mandatory consumer rights available under the laws of Scotland, Northern Ireland, or your country of residence are preserved, allowing you to bring claims in your local courts.

12.2 EU Consumers

EU-resident users retain all mandatory consumer protection rights that cannot be waived by contracts, and may file disputes on the European Online Dispute Resolution (ODR) portal.

12.3 Consumer ADR & Complaints Directory

Please email info@hotelsmint.com first to resolve issues. If unresolved within 60 days, you can address regional services:

12.4 Business Users Exclusive Disputes

For business users and marketplace supplier disputes, both parties submit to the exclusive jurisdiction of the courts of England and Wales, following a mandatory 30-day period of good-faith negotiations.

12.5 Severability Clause

If any clause in these terms is found illegal, void, or unenforceable by an authority, it will be modified to the minimum extent required to make it valid. If not possible, it is severed, leaving the remainder in full effect.
