Please read these terms carefully before accessing or using the HotelsMint platform. They govern your contractual relationship with Bankitt LTD.

PART 1

About HotelsMint & These Terms

1.1 Who We Are

Bankitt LTD (company number 12780965, registered in England and Wales), trading under the brand name "HotelsMint.com", operates the online platform at www.hotelsmint.com. Our registered office is located at 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF. HotelsMint is a multi-service technology platform offering: (a) hotel and accommodation booking services; (b) a guest loyalty and rewards programme; and (c) a B2B supplier marketplace for hotel operators. Financial services (including digital wallet, virtual cards, and fund transfers) are governed separately under our Financial Services Terms.

1.2 Acceptance of Terms

By accessing or using any part of the HotelsMint platform — whether as a guest, a hotel partner guest, a marketplace buyer-seller, or any other platform user — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full. If you do not agree, you must discontinue use immediately. These Terms are supplemented by our Privacy & Cookie Policy, Financial Services Terms (where applicable), and Legal & Ethics Charter, available at www.hotelsmint.com. In the event of conflict, the more specific document prevails.

1.3 Changes to These Terms

We may update these Terms at any time. For material changes, we will provide prominent website notice. Your continued use of the platform after the effective date of any modification constitutes acceptance. If you do not accept the updated terms, you must cease using the platform before the effective date.

Eligibility & Accounts

2.1 Eligibility Criteria

To access, register, or use the HotelsMint platform, you must satisfy the following baseline criteria:

  • Be aged 18 or over for all financial services, digital wallet, and marketplace features.
  • Be aged 16 or over for hotel accommodation booking services (with explicit parental or guardian consent required for users under 18).
  • Possess full legal capacity to enter into binding contracts under the laws of your jurisdiction.
  • Not be subject to financial sanctions, trade restrictions, or prohibitions under applicable export control laws.
  • Provide truthful, accurate, current, and complete information in all interactions with the platform.
  • Not have been previously suspended, restricted, or permanently banned from using HotelsMint services.

2.2 Account Registration Guidelines

Certain platform features require account registration. By registering, you agree to: provide accurate and current information; keep your account details updated; and maintain the strict confidentiality of your login credentials. One account is permitted per person. Creating duplicate or proxy accounts to bypass restrictions, suspensions, or booking limits is strictly prohibited.

2.3 Account Security & Safeguards

You are solely responsible for all activity conducted under your registered account. You must notify us immediately at info@hotelsmint.com if you suspect unauthorized access or compromise. HotelsMint reserves the right to suspend or terminate accounts violating these Terms without prior notice where necessary to prevent harm, security breaches, or financial crime.

PART 3

Hotel Booking Service

3.1 Nature of Service — Intermediary Status

Legal Disclaimer & Intermediary Position

IMPORTANT — INTERMEDIARY STATUS: HotelsMint is a technology intermediary platform, not a hotel, accommodation provider, or travel agency. When you complete a booking through HotelsMint, a direct legal contract for accommodation is formed between you (the guest) and the hotel property (the accommodation provider). Before confirming a booking and transferring payment, review the specific hotel policy and house rules as part of your due diligence. HotelsMint (Bankitt LTD) is NOT a party to that accommodation contract. HotelsMint is therefore NOT liable for the hotel's performance, service quality, property condition, safety compliance, equality law adherence, licensing, or any act or omission by the hotel in any country. This structure aligns with the established industry-standard intermediary model for Online Travel Agencies (OTAs).

3.2 The Booking Process Flow

Bookings are completed through the following standardized procedure:

  1. 1Select your destination hotel, check-in/check-out dates, room type, and guest count.
  2. 2Review the total price, inclusive of all mandatory taxes and charges (see Section 3.4).
  3. 3Review the hotel's property-specific cancellation policy and house rules.
  4. 4Provide accurate guest details and payment authorization.
  5. 5Confirm your booking — this action constitutes your formal offer to the accommodation provider.
  6. 6Receipt of an email booking confirmation from HotelsMint constitutes formal acceptance and establishes a confirmed booking.
  7. 7When completing a booking for a service via the platform, you enter into a direct contract with the relevant Provider (e.g., accommodation operator, airline, car hire firm, tour operator, or activity provider). HotelsMint.com acts as the technology interface platform facilitating the booking.

If you do not receive a booking confirmation email within 24 hours of completing the process, contact info@hotelsmint.com immediately with your transaction reference. You are responsible for verifying all reservation parameters. Failed reservations caused by payment authorization failures or card scheme holds are not eligible for price-lock guarantees or secondary loss coverage; unconfirmed bookings will not guarantee rate preservation.

3.3 Hotel Partner Liability Disclaimer — Global Scope

Legal Disclaimer & Intermediary Position

HOTEL PARTNER LIABILITY DISCLAIMER — ALL JURISDICTIONS: Hotel partners are independent commercial businesses, not employees or legal agents of HotelsMint. HotelsMint does not own, operate, manage, control, or supervise hotel partner properties in any country. Hotel partners are FULLY AND SOLELY LIABLE in every jurisdiction for: the quality, hygiene, safety, and fitness for purpose of accommodation; all health, safety, fire, building, and food safety compliance; non-discriminatory treatment of all guests regardless of race, nationality, religion, gender, sexual orientation, disability, or protected characteristics; staff employment compliance; licensing compliance; guest data security at the property; personal injury, death, or property damage occurring at the premises; tax compliance; and all local regulatory duties. HotelsMint expressly disclaims liability for hotel partner defaults. Service complaints must be addressed directly to the hotel in the first instance.

3.4 Pricing Transparency — DMCC Act 2024

In compliance with the Digital Markets, Competition and Consumers (DMCC) Act 2024 and EU Consumer Rights directives:

  • The price displayed at checkout is the TOTAL PRICE, inclusive of mandatory taxes (VAT, tourism taxes, service charges) and platform fees.
  • Optional extras (such as breakfast, parking, airport transfers, or room upgrades) are displayed separately and charged only when explicitly selected.
  • Local city or municipal tourism taxes are applied or collected according to property policy as disclosed prior to confirmation.
  • HotelsMint strictly prohibits drip pricing, hidden mandatory charges, or deceptive rate displays. Currency conversion rates are displayed transparently at transaction time.

3.5 Cancellation & Refund Policy

Each booking is subject to the specific cancellation terms disclosed prior to booking confirmation:

  • Free Cancellation: You may cancel without penalty up to the property deadline (typically 24–72 hours prior to check-in). After the deadline passes, cancellation charges apply per hotel policy; final decisions reside with the accommodation and inventory provider.
  • Non-Refundable: Full payment is processed at booking; no refund is issued upon cancellation.
  • Partially Refundable: A specified portion or night fee is retained as a cancellation charge per displayed policy terms.
  • Wallet Refund Default: Where a refund is authorized and agreed, it will be credited by default into the user's HotelsMint Wallet (subject to a standard administrative processing fee of £5).

STATUTORY COOLING-OFF EXCLUSION NOTICE: The statutory 14-day cancellation right (cooling-off period) under the Consumer Contracts Regulations 2013 does NOT apply to contracts for hotel accommodation for specific dates (pursuant to Regulation 28(h) and EU Directive Article 16(l)). By confirming a booking, you acknowledge this statutory exclusion. To cancel: Log in → My Bookings → Select Reservation → Cancel, or email info@hotelsmint.com. Eligible refunds are processed within 14 business days following settlement with suppliers/hotels and returned to original payment methods or wallet balances as applicable. In overbooking scenarios, hotels are required to provide equivalent or superior accommodation at no extra cost or issue a full refund.

3.6 Modifications, No-Shows & Force Majeure

Reservation changes, no-show rules, and emergency policies operate as follows:

  • Modifications: Subject to hotel availability and rate policy. Non-amendable rates cannot be modified.
  • No-Shows: Failing to arrive without notice triggers the hotel's no-show policy, which may result in charges of up to 100% of the total booking value.
  • Force Majeure: In events of natural disaster, epidemic/pandemic, or government restriction, HotelsMint will mediate with hotel partners to achieve equitable outcomes. Statutory consumer rights remain fully protected.

3.7 Package Travel Regulations 2018

Where a booking combination qualifies as a 'package' or 'linked travel arrangement' under the Package Travel and Linked Travel Arrangements Regulations 2018 (UK) or EU Directive 2015/2302, HotelsMint will notify you clearly during booking and apply the relevant statutory protections.

PART 4

Rewards Programme

4.1 Programme Overview & Intellectual Property

Legal Disclaimer & Intermediary Position

The HotelsMint Rewards Programme ("Programme") allows eligible users to earn points ("Mint Points") for qualifying platform activity and redeem them for rewards. Participation is voluntary.

VOUCHER MECHANISM & IP NOTICE: The voucher mechanism and issuance infrastructure is the exclusive Intellectual Property (IP) of Bankitt LTD as sole owner. Hotels issue vouchers, and users may distribute, sell, or redeem them on behalf of HotelsMint.com on the platform voucher marketplace subject to standard transaction fees. Vouchers are redeemable through the Programme; no direct cash redemptions are provided by hotels. Instead, customers may utilize voucher amounts as internal credits towards hotel services. Vouchers expire at checkout unless extended upon payment of an extension fee for future returns or marketplace resale. Customers are responsible for fully utilizing vouchers before checkout. Once activated, vouchers are consumed at full value with no residual balance refunded; excess expenditure must be paid by the customer. Expired vouchers revert to HotelsMint.com and will be removed from accounts.

4.2 Accumulating Mint Points

Points are credited for verified qualifying activities including:

  • Completed hotel bookings via HotelsMint (earning rate per £1/€1 spent as displayed in-app).
  • Qualifying HotelsMint Wallet transactions and partner merchant purchases.
  • B2B Supplier Marketplace purchases by hotel operators.
  • Verified referrals completing their initial booking.
  • Promotional campaigns subject to published campaign terms.

Points are credited within 72 hours of confirmed qualifying activity. Points associated with cancelled bookings will be reversed. Misuse or manipulation of points, vouchers, or referral systems will result in points forfeiture, account termination, legal action, and potential referral to law enforcement authorities.

4.3 Nature & Commercial Value of Points

Points carry no direct cash value except as redeemable through the Programme. Points are personal to your account, non-transferable, non-saleable, and do not constitute financial instruments or regulated investments. Redemption rates may be modified with 30 days' prior notice for material changes. Unredeemed points are forfeited upon account closure.

4.4 Points Redemption Options

Points may be redeemed for eligible services across the platform:

  • Hotel Bookings: Applied at checkout to offset booking costs (minimum 500 Points).
  • Wallet Credit: Converted to HotelsMint Wallet balance (minimum 1,000 Points).
  • Partner Rewards: Room upgrades, food & beverage vouchers, or partner services.
  • Marketplace Transactions: Applied against B2B marketplace purchases for hotel operators.

4.5 Membership Tier Status

The Programme features membership tiers (Standard, Silver, Gold, Platinum) determined by qualifying points accumulated over a rolling 12-month period. Tier benefits include elevated earning rates and priority service. Tier thresholds are published at www.hotelsmint.com.

4.6 Points Expiry Rules

Mint Points expire after 12 consecutive months of account inactivity (no qualifying earning or redemption transactions). Any qualifying transaction within the period resets the 12-month expiry window.

4.7 Programme Modification & Termination

HotelsMint reserves the right to modify or terminate the Programme upon 30 days' notice for material changes. In the event of Programme termination, users will be granted 60 days to redeem accrued Points.

PART 5

Supplier Marketplace

5.1 Nature of the Marketplace

MARKETPLACE INTERMEDIARY DISCLAIMER: The HotelsMint Supplier Marketplace is a B2B digital venue connecting hotel operators with vetted hospitality suppliers. HotelsMint functions solely as a technology intermediary. Commercial contracts are formed directly between buyers and suppliers. HotelsMint is NOT a party to supply contracts. Suppliers operate as independent businesses solely responsible for: product safety, quality, and regulatory compliance; delivery, fulfillment, and warranty duties; employment law adherence; equality and non-discrimination compliance; environmental standards; and local statutory obligations. HotelsMint's liability regarding Marketplace transactions is limited strictly to the platform transaction fee received for the specific transaction.

5.2 Marketplace Buyer Conduct

Marketplace buyers must transact in good faith, avoid discrimination against suppliers on any protected grounds, execute prompt payment according to agreed terms, and comply with all applicable commercial laws.

5.3 Prohibited Marketplace Listings

The following categories are strictly prohibited from Marketplace listing:

  • Counterfeit, infringing, or unauthorized goods.
  • Products violating UK or EU product safety standards.
  • Controlled substances, weapons, or hazardous materials.
  • Professional services requiring unverified or missing legal licences.
  • Any item or service whose sale constitutes a criminal offence under applicable law.
PART 6

Intellectual Property & Usage Rights

6.1 Platform Ownership & Licence Terms

All content across the HotelsMint platform — including text, visual graphics, logos, brand trademarks, software code, database structures, and interface design — is owned by or licensed to HotelsMint and protected by UK and international IP law. Users are granted a limited, non-exclusive, non-transferable, revocable licence for intended personal or internal commercial use. Copying, reverse-engineering, decompiling, or commercial exploitation without prior written consent is strictly prohibited.

6.2 User-Submitted Content & Reviews

By submitting content (reviews, photos, feedback, listings) to HotelsMint, you grant us a worldwide, royalty-free, perpetual, sub-licensable licence to use, reproduce, modify, and display that content for platform operation and promotion. You warrant that you hold all necessary rights and that your content does not violate third-party rights.

PART 7

Acceptable Use Policy

7.1 General Prohibited Conduct

Users must not engage in any of the following prohibited platform activities:

  • Any unlawful act under English law or applicable local legislation.
  • Money laundering, terrorist financing, fraud, or financial crime activities.
  • Providing false, misleading, or deceptive information in accounts, bookings, or reviews.
  • Impersonating any individual, entity, or official representative.
  • Interfering with, disrupting, or probing platform servers, networks, or infrastructure.
  • Deploying automated scrapers, bots, crawlers, or data extraction scripts without express authorization.
  • Attempting unauthorized access to system security controls or user data.
  • Bypassing or manipulating fraud prevention mechanisms.

7.2 Fake Reviews & Deceptive Practices — DMCC Act 2024

Submitting, commissioning, or incentivising fake reviews is a criminal offence under the DMCC Act 2024 for business users. HotelsMint maintains zero tolerance for fraudulent reviews, employing automated detection and manual verification. Violations result in review removal, account termination, and referral to the Competition and Markets Authority (CMA). Drip pricing, deceptive was/now pricing, false scarcity signals, and subscription traps are strictly prohibited.

7.3 Discrimination & Hate Speech Zero Tolerance

Critical Policy Warning: Zero-Tolerance Policy

ZERO TOLERANCE FOR DISCRIMINATION & HATE SPEECH: HotelsMint prohibits absolutely, in all languages and contexts on the platform: racism, xenophobia, antisemitism, Islamophobia, homophobia, transphobia, or any prejudice based on race, colour, nationality, ethnic origin, religion, gender, sexual orientation, disability, age, political opinion, language, caste, or protected characteristic. Offending content will be removed immediately, accounts permanently banned, and conduct constituting a criminal hate offence under the Public Order Act 1986, Crime and Disorder Act 1998, or Online Safety Act 2023 reported to Law Enforcement.

7.4 Anti-Human Trafficking & Exploitation

Using the platform to facilitate human trafficking, modern slavery, forced labour, or sexual exploitation is absolutely prohibited. Any suspected trafficking activity will be reported to the National Crime Agency (NCA) immediately.

PART 8

User Reviews & Guidelines

8.1 Review Submission Policy

User reviews must reflect genuine, first-hand personal experiences, be truthful, original, and free of third-party personal data. HotelsMint reserves the right to remove content violating our guidelines without prior notice. We do not edit review text to alter sentiment or meaning.

PART 9

Third-Party Links & Services

9.1 External Integrations & Services

The platform may feature links or integrations with third-party websites, hotel partner booking portals, payment processors, mapping services, or marketing tools. HotelsMint is not responsible for third-party content, terms, or privacy practices. Third-party services are used entirely at your own risk.

PART 10

Limitation of Liability

10.1 Financial Liability Caps

To the maximum extent permitted by law, HotelsMint's total aggregate liability arising out of or connected with platform usage shall not exceed:

  • Hotel Bookings: The total monetary value of the specific booking giving rise to the claim.
  • Marketplace Transactions: The total monetary value of the specific transaction giving rise to the claim.
  • Rewards Programme: The equivalent redemption value of disputed Mint Points.

10.2 Excluded Categories of Loss

We exclude liability for: acts, defaults, or omissions by hotel partners or marketplace suppliers; accuracy of hotel descriptions, images, or amenity lists; loss of profit, revenue, business opportunity, goodwill, or data; indirect, consequential, or special damages; and platform unavailability due to maintenance or force majeure events.

10.3 Non-Excludable Rights

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory consumer right that cannot be waived under English law.

10.4 Financial Services Liability Scope

Liability in connection with wallet, virtual cards, and payment services is governed separately under our Financial Services Terms and the Payment Services Regulations 2017.

PART 11

Indemnification

11.1 User Indemnity Obligations

You agree to indemnify, defend, and hold harmless HotelsMint, Bankitt LTD, and their respective directors, officers, employees, and agents against all claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, violation of law, submission of unlawful content, or infringement of third-party rights.

Dispute Resolution & Laws

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales and Scotland. Mandatory consumer protection rights available under the laws of your country of residence remain fully preserved.

12.2 EU Consumer Rights

Users residing in European Union member states retain all mandatory consumer protection rights that cannot be waived by contract under local consumer law.

12.3 Consumer Complaints & Regulatory Bodies

We encourage contacting info@hotelsmint.com first to resolve disputes informally. Unresolved complaints after 60 days may be escalated to official bodies:

12.4 Business User Dispute Resolution

Commercial disputes between HotelsMint and business users or marketplace participants fall under the exclusive jurisdiction of the courts of England and Wales following a mandatory 30-day good-faith negotiation period.

12.5 Severability

If any provision is found invalid or unenforceable by a competent authority, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is impossible, leaving remaining provisions in full effect.
